AND CALIFORNIA PRIVACY NOTICES

ParcelQuest operates this website for informational and commercial purposes.  This Privacy Policy describes the policies by which we operate our website, including how and to what extent we collect information from you and other website users and visitors.  For purposes of this Privacy Policy, the terms “ParcelQuest”, “we,” “us” and “our” include our company and our affiliates, which are subsidiaries or other entities though which we operate and in which we have a direct or indirect ownership interest.  This Privacy Policy applies to the information we collect through our websites, mobile applications, electronic devices, and other print and digital products and services we provide, and all associated content, functionalities and advertising (collectively, the “Services”).  This Privacy Policy governs the Services regardless of how you access them.  In addition, some Services may have specific, separate privacy policies that will govern use of those Services.

In this Privacy Policy, we will describe (1) the information we collect and how we collect it; (2) what we do with the information we collect; (3) if and to what extent we may disclose user information to third parties; (4) how we use online analytics and tailored advertising; (5) the California Do-Not-Track disclosure requirements; (6) the extent to which you can access and update your information; (7) how we protect information; (8) linked sites and advertisements; (9) use of the Services by children or users from outside the United States; (10) how to contact us; (11) the absence of rights of third parties; (12) changes to this Privacy Policy; and (13) Notices and Privacy Rights applicable to California Residents.

Information We Collect and How We Collect It

How we collect and store information depends on the Services you use.  You can use some of the Services without providing any information other than information which is automatically collected.  Other Services you may require that you provide information to us in order to access or pay for the Services.  Both are described below.

A. User-Provided Information

We may collect and store information about you during your use of the Services.  The types of information we collect include things like your name, username, password, email address, postal address, phone number, mobile phone number, payment information, gender, and birth year.  You provide this information to us when you do things like enter registration information for one or more of our Services; make a purchase or payment; sign up to receive notifications; download data or applications; use mobile applications; connect or use the Services in connection with your social networking sites (SNS); navigate our websites and mobile applications; or submit your information to us for any other reason.

When you sign in to your account or mobile application with your SNS account information or otherwise connect your SNS account with the Services, you authorize us to collect, store, and use in accordance with this Privacy Policy any and all information available through the SNS interface, including information that you have made public in connection with your SNS account, information that the SNS shares with us, and information that is disclosed as being shared during the sign-in process.  For Example, we may collect and store your user ID associated with an SNS account that you use to sign in to your account or connect or use with the Services.  Please be careful and responsible whenever you are online.  Should you choose to voluntarily disclose information in connection with your use of the Services, such as via an SNS, that information may be viewed and/or collected and used by third parties without our knowledge or consent and may result in data collection by or unsolicited messages from other individuals or third parties.

B. Automatically-Collected Information

Device/usage information: We may automatically collect certain information about the computer or devices (including mobile devices) you use to access the Services.  For example, we may collect and analyze information such as (a) IP addresses, geolocation information, unique device identifiers, including mobile advertising identifiers, and other information about your mobile devices, browser types, browser language, operating system, the state or country from which you accessed the Services.  We may also automatically collect and analyze information related to the ways in which you interact with the Services, such as referring and exit pages and URLs, platform type, clicked items, interaction with aspects of the website, domain names, landing pages, pages and content viewed and the order of those pages, the amount of time spent on particular pages, mouse hover location or time, the date and time you used the Services, the frequency of your use of the Services, error logs, and other similar information.  We may use third-party analytics providers and technologies, including cookies and similar tools, to assist in collecting and analyzing this information.  We may also capture other data, such as search criteria and results, which we may associate with a unique identifier for our internal use.  If we capture data and assign unique identifiers in this manner, your identifier will be considered our information, and nothing in this Privacy Policy restricts how we may use this information.

C. Location information

We may collect different types of information about your location, including general information (for example, IP addresses or ZIP codes) and more specific information (for example, GPS-based data from mobile devices used to access the Services).  If we collect this location information, we may use it to customize the Services we provide, and we may use it for advertising.  If you access the Services through a mobile device and you do not want your device to provide us with location-tracking information, you may be able to disable the GPS or other location-tracking functions on your device, provided your device allows you to do this.  See your device manufacturer’s instructions for further details.

D. Cookies and Other Electronic Technologies

We use cookies and other similar tracking technologies when you use the Services.  We use cookies and similar technologies for many purposes, including:  (a) to store your username and password;  (b) to monitor and analyze your usage of our sites and Services;  (c) to customize the Services to your explicit and inferred preferences; and  (d) to tailor advertising and advertisements on our or other websites or mobile applications.  We, along with our vendors, may also use other Internet technologies, such as Flash technologies, Web beacons or pixel tags, and other similar technologies, to deliver or communicate with cookies and/or track your use of the Services, to personalize/customize your experience when you are using our Services or other websites when those cookies can be accessed, and for targeted advertising purposes.  We also may include Web beacons in email messages, newsletters and other electronic communications to determine whether the message has been opened and for other analytics, personalization and advertising.  As we adopt additional technologies, we may gather additional information through other methods.

Most browsers automatically accept cookies, but you may be able to modify your browser setting to decline cookies by visiting the Help portion of your browser’s toolbar.  If you choose to decline cookies, you may not be able to sign in, customize, or use some of the interactive features of the Services.

We may also use Flash cookies.  Flash cookies operate differently than browser cookies, and cookie management tools available in a web browser will not remove Flash cookies.  To learn more about how to manage Flash cookies, you can visit the Adobe website and make changes at the Global Privacy Settings Panel.  Please note that limiting third-party cookies through your browser controls will not necessarily opt you out of first- or third-party interest-based advertising, as some technologies may not respond to these browser controls.

E. Information Provided by Third Parties

We may obtain additional information about you from third parties such as marketers, partners, researchers, social networks, data services companies (e.g., for data enhancement) and others.  We may combine information that we collect from you with information about you that we obtain from such third parties and information derived from any other subscription, product, or service we provide.

F. Collection of Information Across Devices and Applications

We may use information we collect from you and your devices, such as log-in credentials, IP addresses, hashed email addresses, and unique mobile device identifiers, to locate or try to locate the same unique users across multiple browsers or devices, like smartphones, tablets, or computers, in order to better tailor content, features, and advertising, and provide you with a seamless experience across the devices you use to access the Services.  We may also work with third party service providers or vendors who do this, and share information we have collected to enable them to do so, for the same reasons.

2. What We Do with the Information We Collect

We use the information that we collect for the many purposes.  These include the purposes for which you provided the information; to process and respond to your inquiries; to contact or interact with you about your relationship or transactions with us; to send you notices or other communications via SMS messages or other media or networks; to notify you about new features of the Services or products, services, and special offers; to contact you with information that we believe may interest you; to generate and review reports and data about our user base and usage patterns of the Services; to perform analytics and research aimed at improving the accuracy, effectiveness, usability, or popularity of the Services; to offer, manage, monitor and improve the content and features of the Services or develop new Services; to allow us to personalize or otherwise provide content and/or advertising and to understand how users interact with and use our advertisements and Services; to enforce the legal terms that govern your use of the Services; to administer and troubleshoot the Services; to associate your activities, customize content or tailor advertising across different devices and browsers that you use to access the Services; and to send you offers and advertisements through various channels, whether on our behalf or on behalf of marketing partners with whom we may engage.  We may send you commercial emails on behalf of ourselves, our affiliates, or advertisers.  Each such email we send you will have an opt-out that you can use to stop receiving such communications.

3. Sharing and Disclosure of User Information with Third Parties.

We may make your information available to other companies, websites, applications or people in the following circumstances:   (1)  We may share, rent, or sell your information with non-affiliated third parties to provide services or products that you have requested; when we have your permission to do so; or as otherwise described in this Privacy Policy.  (2) We may share your information with our agents or affiliates as may be necessary to provide the Services or our advertising to you, or to communicate with you on our behalf.   (3) We may provide access to or share your information with select third parties who perform services on our behalf, such as billing, sales, marketing, provision of content and features, advertising, analytics, research, customer service, shipping and fulfillment, data storage, security, fraud prevention, payment processing, and legal services.  (4) We may share your information with third parties for their own, and sometimes our own, advertising and marketing purposes.

We also may access, disclose, transfer and preserve your information, provided we have a good faith belief that doing so is necessary, for the following reasons:  (1) to protect the legal rights, privacy or safety of you, our other users, or of ourselves and that of our affiliates, employees, agents, contractors, or other individuals, including by enforcing this Privacy Policy or our Terms of Use Agreement;  (2) to comply with the law including with subpoenas, search warrants, court orders, and other legal processes; (3) to respond to inquiries or requests from government, regulatory bodies, law enforcement, public authorities, or content protection organizations;

(4) to permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages that we may sustain; and (5) to enforce this Privacy Policy or our Terms of Use Agreement.

We may share your information in connection with any proposed or actual merger, reorganization, transfer of control, a sale of some or all of our assets, or a financing or acquisition of all or a portion of our business by another company.

Lastly, we may aggregate and de-identify information collected by the Services or via other means so that the information is not intended to identify you.  Our use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.

4. Use of User Information for Online Analytics and Tailored Advertising.

A. Online Analytics

We may use third-party web analytics services on our Services, such as those of Google Analytics, Adobe Omniture, and similar providers.  These service providers use the sort of technology described above to help us analyze how users use the Services, including by noting the third-party website from which you arrive.  The information (including your IP address) collected by the technology will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services.  We also use Google Analytics for certain purposes related to advertising.  To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on available from Google.

B. Tailored Advertising

When you use the Services, we may serve you with ads based on various factors such as the content of the page you are visiting, information you provide such as your age or gender, your searches, demographic and geographic data, user-generated content and other information that you provide to us. These ads may be based on your current activity or your activity over time.  Should you access websites of third parties, including those whose products or services are accessible or advertised though the Services, those third parties, or their agents, may place cookies or other tracking technologies on your computer browser, mobile phone applications, or other device to collect information about your use of the Services in order to provide targeted advertisement based on past visits to our websites and other sites or mobile applications and/or to analyze and evaluate the effectiveness of advertising efforts.  We may also allow other third parties (for example, ad servers like Google AdSense or DoubleClick) to access their own cookies or other tracking technologies on your computer, mobile phone, or other device that you use to access the Services so that tailored ads may be delivered to you when you are using other websites and mobile applications.  We also may share with third-party advertisers a hashed version of your email address, which may be identified by a service provider for purposes of delivering tailored advertising on the Services, other websites, and/or mobile applications.

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your computer, mobile phone, or other device you use to access the Services by non-affiliated, third-party ad technology, ad servers, ad networks or any other non-affiliated third parties.  Those parties that use these technologies may offer you a way to opt-out of ad targeting.  If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver interest-based advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s (DAA’s) Consumer Opt-Out link or TrustArc’s Advertising Choices Page to opt-out of receiving tailored advertising from companies that participate in those programs.

If you have a Google account, we may use Google Analytics to display advertising to you.  You can opt-out of Google Analytics for display advertising or customize Google display network ads by visiting the Google Ads Settings page.  We may work with platform providers who serve advertising across devices if we want to reach our web-based customers when they are on their mobile devices.  This is done, generally, by correlating common attributes (such as IP addresses, other browser or device information or hashed email addresses) across devices, to infer a common identity across multiple channels.  You can opt-out of this type of advertising by employing the opt-out functionality of each separate device or browser.  You can also opt-out of ‘cross-app’ advertising, which is interest-based advertising associated with your use of mobile applications through your device settings.  Each operating system provides its own instructions on how to prevent the delivery of tailored in-application advertisements.  The availability and effectiveness of these instructions are controlled exclusively by the applicable platform operator.

Please note that to the extent advertising technology is integrated into the Services, you may still receive advertisements even if you opt-out of tailored advertising.  In that case, the ads will not be tailored to you or based on your information.

5. Do-Not-Track Disclosure

We are committed to providing you with meaningful choices about the information collected on our Services for third-party purposes, and that is why we provide above information concerning opt-out options and procedures.  We do not, however, recognize or respond to browser-initiated Do Not Track signals, as the industry has not yet developed definitive Do Not Track standards, implementations or solutions.

6. How You Can Access and Update Your Information

To ensure that you have some control over the information we have about you, you may review and update certain user profile information by logging in to the relevant portions of the Services where such information may be updated (may be available on some Services and not others) or by contacting us at privacy@ParcelQuest.com.

7. How We Protect Your Information

We have implemented a variety of administrative, technical, and physical security measures to protect against the unauthorized access, destruction or alteration of your information.  These safeguards vary based on the sensitivity of the information that we collect, process and store and the current state of technology.  Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot guarantee that information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy.

8. Linked Sites and Advertisements

The Services may contain links to third-party websites.  We are not responsible for the privacy practices or the content of those third-party websites.  Although we have relationships with third-party providers to provide content, products, services, and functionality through the Services, when you visit third-party sites or use any Services in conjunction with third-party providers, such third parties may have privacy policies which differ materially from this Privacy Policy.  You are encouraged to review the relevant privacy policies of all third party sites you may visit to determine the information collection, retention and use policies of each such site.  When you access linked sites or otherwise use third party sites in connection with your use of the Services, we may share any information you provide or that is collected during your use of those Services with those providers.

The Services may also contain third party advertisements.  Such advertisers may request, and you may elect to directly provide, information such as your name, home address, or email address to such advertisers.  When you provide information in that manner, the information you submit may be used by the advertiser in any way that it chooses, including to market to you, or to share with or sell to others.  The information may be covered by that advertiser’s separate privacy policy, but in many cases that advertiser may not have any separate online presence or applicable privacy policy.  You should therefore only submit your information in these cases when you are comfortable doing so given the above conditions, and if you have any questions about the privacy practices of an advertiser, you should contact the advertiser directly.

9. Use of the Services by Children or Users from Outside the United States

The Services are not intended for persons under the age of 13, and the Services do not include content for or directed towards children or families.  We do not intend to collect or share information of children under the age of 13, and we do not provide family content in the Services specifically for that reason.  If we learn we have collected personal information from a child under the age of 13 in a manner inconsistent with legal requirements, we will delete the personal information.  A parent or guardian may contact privacy@ParcelQuest.com to review personal information provided by the parent’s or guardian’s child and have such information deleted.

The Services are hosted in the United States and are governed by United States law.  If you are using the Services from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States, and in any other countries where we may locate our servers or operate our databases.  The data protection and other laws of the United States and other countries might not be as comprehensive or protective of certain rights as those in your country.  Under United States law, your information may be subject to access requests from governments, courts, or law enforcement in the United States.  By using the Services, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Policy and processed in those facilities.

11. No Rights of Third Parties

This Privacy Policy does not create any rights enforceable by third parties.

12. Changes to this Privacy Policy

ParcelQuest may change this Privacy Policy at any time and for any reason in its sole discretion.  ParcelQuest may make such changes to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology.  Your use of the Services following the posting of changes to this Privacy Policy shall conclusively establish your consent to those changes.

13. Notices and Privacy Rights of California Residents

If you are a California resident, you may have certain rights relating to your privacy and use of the Services.  The following notices and disclosures are intended to comply with the California Consumer Privacy Act of 2018 and related regulations (the “CCPA”).  The following provisions supplement the information in our Privacy Policy set forth above and applies only to California residents.  The following provisions apply to personal information we collect on or through the Services and through other means, such as information collected offline, in person, or over the telephone.  These provisions do not apply to personal information we collect from our employees or job applicants.

A. Data Collection, Source, Purpose and Disclosure Notice

California law, including the CCPA, requires us to disclose four categories of information.  Specifically, we are required to disclose (1) the categories of personal information that we collect about California consumers; (2) the categories of sources from which the information was collected; (3) the business or commercial purposes for which the information was collected; and (4) and the categories of parties with whom we share personal information.

Notice of Collection: We collect the following types of information from California Consumers who use our Services:

1. Identifying Information, such as such as name, billing and shipping addresses, email address, billing information, username, any provided phone numbers, such as home, mobile or fax, online screen name, security questions and password;

2. Commercial Information, such as records of your purchases and transaction data;

3. Financial Information, such as credit or debit card number, verification number, and expiration date, to process payments and information about your transactions and purchases with us, but only to the extent necessary to process a transaction or, in the case of a subscription, a series of related transactions;

4. Device Information and Identifiers, such as IP address, browser type and language, operating system, platform, device, software and hardware attributes, and unique device, advertising, and app identifiers;

5. Network and Electronic Activity Information, such as information about files you download, domain names, landing pages, browsing activity, content or ads viewed and clicked, dates and times of access, pages viewed, forms you complete or partially complete, search terms, uploads or downloads, the URL that referred you to our Services, whether you share our content to social media platforms, and other web usage activity and data logged by our web servers like whether you open an email and your interaction with email content, access times, error logs, and other similar information;

6. Location Information, such as general location, and, to the extent you may access the Services through a mobile application, GPS location information;

7. Social Media Information, provided you access the Services through a third-party connection or log-in, information such as personal identifiers, location data, user generated content, demographic information, any information you provide to that social network depending on your privacy settings, such as your name, email address, friend list, photo, gender, location, and current city, and any information you provide to us directly through our pages on social networking and blogging platforms;

8. Audio Recordings, to the extent you may contact us via telephone your calls may be recorded;

9. Other information, such as any other information you choose to directly provide to us in connection with your use of the Services.

Sources of Collection: We collect the above-noted information from you and your devices when you use the Services or access our websites.  Information is collected either automatically upon accessing the website or using the Services or from information you provide us in connection with your use of the Services.  How we collect this information is described in detail above.  We may also obtain information from our affiliates, vendors, service providers and public records databases, as well as consumer data resellers or brokers.

Business Purposes for Collection: We collect your information for the following business or commercial purposes:

1. to provide the Services to the users, for example tailoring the content of the Services to the user’s stated preferences, user account servicing and maintenance, customer service, and communicating with users about the Services and the user’s account;

2. for our operational purposes, for example publishing the website and its content, and analyzing and evaluating website analytics to enable the website to operate efficiently;

3. for auditing consumer interactions on our site;

4. to detect, protect against, and prosecute security incidents and fraudulent or illegal activity;

5. for bug detection, error reporting and website repairs and maintenance;

6. to customize content that we or our service providers display on the Services;

7. to improve our existing Services and develop new services, including research and development for new products or features; and

8. for other uses that advance our commercial or economic interests, such as communicating with users and potential customers about relevant products and services available from us and from third parties.

Categories of Third Parties with Whom We Share Information: We may share your information with non-affiliated third party vendors that assist us in providing the Services and our advertising to you, or to communicate with you.   We may share your information with select third parties who perform services on our behalf, such as billing, sales, marketing, provision of content and features, advertising, analytics, research, customer service, shipping and fulfillment, data storage, security, fraud prevention, payment processing, and legal services.  We may share or disclose your information to law enforcement and other governmental agencies, regulatory bodies, public authorities, content protection organizations, courts, court staff, litigants, attorneys, and attorney service vendors, as may be compelled by or required to comply with subpoenas, search warrants, court orders, and other legal processes, or as may be warranted in cooperation with such third parties to protect the legal rights, privacy or safety of you, our other users, or of ourselves and that of our affiliates, employees, agents, contractors, or other individuals, or to enforce this Privacy Policy or our Terms of Use Agreement, pursue available remedies, commence, participate in, or defend litigation, or limit the damages that we may sustain.  We may share your information with third parties for their own advertising and marketing purposes.  We may share your information with another company and its agents in connection with a proposed or actual merger, reorganization, transfer of control, a sale of some or all of our assets, or a financing or acquisition of all or a portion of our business by another company.  Your information may also be included in information which we have collected, aggregated and de-identified such that it is not intended to identify you, and we may use this aggregated, de-identified information for any purpose.

B. Do Not Sell My Personal Information

California residents may opt out of the “sale” of their personal information.  We do not sell your information to third parties.

However, under the CCPA, the term “sale” is broadly defined in a manner which could be construed to sharing data, such as cookies, IP address, and/or browsing behavior, with third parties in order to deliver targeted content or advertising on the Services, related to the Services or in connection with payment for the Services.  Depending on what Services you use, we may provide the following categories of personal information to third parties for these purposes:  For online targeted advertising purposes: demographic and statistical information, device information and identifiers, browser and usage data, geolocation, and social media information.  For sharing with third parties to send you relevant offers, products, promotions and opportunities: contact and registration information, demographic and statistical information, employment data, user-generated content, device information and identifiers, browser and usage data, and geolocation.

If you would like to opt out of our use of your information for purposes that may be considered a “sale” under California law, you may submit a sale opt-out request by emailing us at privacy@ParcelQuest.com.

C. Additional Rights of California Consumers

California law provides additional rights to California residents.

First, you may request that we provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.  In addition, you may request that we provide access to, or a copy of, certain information we hold about you, or that we delete certain information we have about you.  You should direct all such requests to us at privacy@ParcelQuest.com.  We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, and physical address.  You may also designate an agent to submit certain requests on your behalf, provided that you give the authorized agent explicit written and signed permission or a power of attorney.  Before processing a request submitted by an agent, we may, but are not required to, follow up with you to verify your identity and your agent’s authority to make the request on your behalf.

Second, you may have the right to receive information about financial incentives we may offer you.

Third, you have the right to not be discriminated against for exercising certain of your rights.

Fourth, California law may require us to compile metrics for the previous calendar year regarding consumer requests and responses.  We intend to compile and disclose such metrics to the extent and in the manner required by law.

Fifth, users who are California residents may request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information for their direct marketing purposes in the prior calendar year.  Such list must describe the type of personal information disclosed to those parties.  California residents may submit such requests via email to privacy@ParcelQuest.com.

Lastly, if you are a California resident, under the age of 18, and are a registered user of our Services, you may be entitled to request that we remove content you posted if such content can be accessed by any other user.  To request removal of content under this provision, please send an email to privacy@ParcelQuest.com and that includes a detailed description of the content and the location of the content on our Services, along with any other information that may be necessary or helpful to process your request.  Content removed from the Services may remain on our servers and in our systems after your request is processed.  In addition, content removal under this provision cannot ensure complete or comprehensive removal of the content from the internet, from devices of other users or from any location other than the content may have been copied, printed, cached or stored.

Please note that certain information may be exempt from these types of requests under applicable law.  If you submit a request under any of the categories of requests noted in this section, our response will typically not include any information which is either exempted or prohibited from being disclosed.

Please also note that we need certain types of information about you so that we can provide the Services to you.  If you ask us to delete it, or if you refuse to provide it, you may not be able to access or use the Services.
